Welcome to Indie Intrepid! These Terms of Service (” Terms “) govern your access to and use of the Indie Intrepid website at indieintrepid.com (the ” Site “). The Site is operated by the owners of Indie Intrepid (referred to as ” Indie Intrepid “, ” we “, or ” us “). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (which is incorporated herein by reference). If you do not agree with these Terms, please do not use our Site.

1. Acceptance of Terms

By using this Site, you confirm that you are at least 13 years of age (or older if required in your jurisdiction for consent to online services) and that you agree to these Terms. If you are using the Site on behalf of an organization or other entity (for example, if you are an author contributing an article or a business using our content), you represent and warrant that you have the authority to bind that entity to these Terms, and in that case “you” and “your” will refer to that entity.

Account Creation: Our Site currently does not require user accounts to access content. You may browse and read our blog freely. However, to comment on posts or subscribe to our newsletter, you may need to provide certain information (like a name and email). You agree that any information you provide will be accurate and that you will not impersonate anyone or provide false details.

2. Use of the Site

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use our Site and its content for your own personal, non-commercial use only, in accordance with these Terms . You may not use the Site for any unlawful or unauthorized purposes.

Prohibited Conduct: By using Indie Intrepid, you agree not to engage in any of the following activities:

Unauthorized Advertising or Spam: Do not post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.
Harassment or Hate: Do not use the Site to threaten, harass, bully, or harm others, or to post content that is defamatory, libelous, obscene, pornographic, vulgar, or offensive, or that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. This especially applies to any user-generated content areas, like comments.
Impersonation and False Information: Do not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity when using the Site (such as in a comment or contact form).
Malicious Technological Acts: Do not introduce viruses, malware, or any other harmful code that could damage or interfere with the Site or other users’ devices. Also, do not attempt to gain unauthorized access to our Site or server (no hacking, password mining, or other illegitimate means).
Interference with the Site: Do not attempt to disrupt or impair the normal operation of the Site. This includes actions like launching denial-of-service attacks, overloading the Site infrastructure, or otherwise interfering with the Site’s functionality.
Scraping and Data Mining: Do not use any automated means (such as bots, scrapers, or spiders) to access the Site, extract data, or gather content without our express permission. The only exception is public search engine indexing for the sole purpose of creating publicly available search indices (commonly known as crawling, which is allowed).
Unapproved Commercial Use: Do not use the Site or its content for any commercial purposes without our permission. This means you should not resell our content, use our reviews or guides to directly promote your own competing business in a misleading way, or engage in unauthorized affiliate marketing on our Site.

If we determine, in our sole discretion, that you have engaged in any prohibited conduct or violated any part of these Terms, we reserve the right to terminate or restrict your access to the Site immediately and without notice (see Termination below). We may also take any legal action we deem appropriate.

3. Intellectual Property Rights

You herein acknowledge, understand and agree that all of the Indie Intrepid trademarks, copyright, trade name, service marks, and other Indie Intrepid logos and any brand features, and/or product and service names are trademarks and as such, are and shall remain the property o f Indie Intrepid. You herein agree not to display and/or use in any manner the Indie Intrepid logo or marks without obtaining Indie Intrepid’s prior written consent.

Indie Intrepid will always respect the intellectual property of others, and we ask that all of our users do the same. With regards to appropriate circumstances and at its sole discretion, Indie Intrepid may disable and/or terminate the accounts of any user who violates our Terms and/or infringes the rights of others. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, you should provide to us the following information:

The electronic or the physical signature of the individual that is authorized on behalf of the owner of the copyright or other intellectual property interest;
A description of the copyrighted work or other intellectual property that you believe has been infringed upon;
A description of the location of the site which you allege has been infringing upon your work;
Your physical address, telephone number, and email address;
A statement, in which you state that the alleged and disputed use of your work is not authorized by the copyright owner, its agents or the law;
And finally, a statement, made under penalty of perjury, that the aforementioned information in your notice is truthful and accurate, and that you are the copyright or intellectual property owner, representative or agent authorized to act on the copyright or intellectual property owner’s behalf.

4. User Content and Contributions

Our Site may allow users to contribute content in certain areas – for example, by posting comments on blog posts or submitting content via our “Become a Contributor” page. We value community interaction, but we also need to ensure the Site remains a safe and enjoyable space. By submitting any content to our Site (including comments, guest posts, or any form of user contribution), you agree to the following terms:

Responsibility for Your Content: You are solely responsible for any content that you post or submit on our Site. This includes any text, images, links, or other material. You represent that your contributions are your own original work (or that you have all necessary rights from the owner to post it) and that your content does not infringe or violate the rights of any third party (including copyright, trademark, privacy, or publicity rights). This license is necessary for us to display your content on our Site and to make backups or promotional use of it. You retain any copyright or other ownership rights you have in your content; this is not a transfer of ownership, just a permission for us to use it.
Community Guidelines and Moderation: We have the right, but not the obligation, to monitor user-generated content. We may remove or edit any user content at our discretion for any reason. This may include content that we find to be in violation of these Terms, off-topic, inappropriate, or potentially unlawful. We also reserve the right to disable or restrict a user’s ability to post if they repeatedly violate our guidelines. That said, we are not responsible for any delay or failure in removing content. If you see content posted by others that you believe violates these Terms or is otherwise problematic, please let us know.
No Endorsement: Any opinions, advice, statements, or other information posted by users (in comments or contributions) are those of the respective authors and not of Indie Intrepid. We do not endorse and are not responsible for the accuracy or reliability of any user-generated content on our Site. Use of or reliance on any user content is at your own risk.
Contributor Articles: If you submit a guest article or become a contributor, additional terms may be agreed upon (for example, regarding editing, exclusivity of the content, or compensation). Typically, by submitting an article, you affirm it’s original and grant us permission to publish it. We may edit contributions for clarity, length, or compliance with our style and standards. We will credit you as the author (unless you prefer to be anonymous or it’s a collaborative piece). The general license you grant (as stated above) applies to contributor content as well, so we can display and promote the article. If we have specific contributor agreements, those will supplement these Terms.

User Content Removal: If you wish to remove or delete content that you have posted, such as a comment, please contact us. We will attempt to accommodate removal requests for your own content, but note that removal might not be immediate and cached or archived versions might persist.

5. Affiliate Links and Sponsored Content

Transparency and trust with our readers are extremely important to us. We want you to be aware of our monetization strategies and know when we might benefit from something you click or read. Here’s what you should know:

Affiliate Links: Indie Intrepid participates in affiliate marketing programs. This means some of our blog posts and pages contain special tracked links to products or services. If you click on an affiliate link and then make a purchase, we may earn a small commission at no additional cost to you . For instance, we are a participant in the Amazon Services LLC Associates Program. As an Amazon Associate, we earn from qualifying purchases. These affiliate relationships do not influence our editorial content; we only recommend products or services that we genuinely believe are valuable to our audience or that we have personally found useful. Affiliate commissions help support our work (allowing us to maintain the site, create content, and keep most content free of charge).
Sponsored Posts and Partnerships: From time to time, we may collaborate with brands on sponsored content or accept forms of compensation (such as sponsored blog posts, paid reviews, or social media campaigns). Whenever we receive compensation or free products/services in exchange for our content, we will clearly disclose this within the content in accordance with Federal Trade Commission (FTC) guidelines. Also, an affiliate or sponsorship relationship will never cause us to falsely praise a poor product or hide negative aspects. Our reputation with you, our readers, is paramount. Third-Party Responsibility: When you click on an affiliate link or sponsored content and navigate to a third-party site (like Amazon, another retailer, or a sponsor’s website), your interaction there is solely with that third party. We are not responsible for anything that happens on third-party sites, including if you purchase a product or service. Indie Intrepid cannot provide support or accept any liability for third-party products or transactions.

We appreciate when you use our affiliate links because it helps us continue our blogging journey, but there is never any obligation to do so. We aim to be transparent and uphold the trust you place in us.

E-commerce Platforms: If we direct you to purchase merchandise or digital products via a third-party platform (for example, our Shop link might take you to an Etsy store or Printify page where Indie Intrepid merchandise is sold), that transaction is not happening on our Site. Indie Intrepid is not responsible for any issues arising from such transactions (although if you have a problem with a product that we ourselves are selling on a platform like Etsy, please do contact us and we’ll try to assist or direct you to the right support).
Social Media and Other Services: The Site may enable you to share content to social media or may link to our profiles (e.g., our Instagram, Facebook, or YouTube pages). Use of those platforms is subject to their own terms. Also, if we embed content (like a YouTube video or an Instagram feed), those providers might collect data through cookies or embeds, as explained in our Privacy Policy. We are not liable for how those third-party services operate.

In summary: When you interact with a third-party link or service through our Site, you should exercise appropriate caution and review that third party’s terms and policies. We want you to have a great experience on Indie Intrepid and beyond, but we cannot be responsible for the wider internet.

Indie Intrepid is a labor of love, and we strive to provide valuable, accurate, and inspiring content. However, we need to make clear certain disclaimers about the content and your use of the Site:

Use at Your Own Risk: Your use of the Site and reliance on any information obtained through the Site is at your own risk . While we put effort into researching and presenting our travel guides, remote work tips, reviews, and other content, we cannot guarantee that all information is completely current, accurate, or suitable for every individual. (For example, travel conditions can change rapidly, businesses may alter their services, and what worked for us might not work for you in exactly the same way.) Always exercise your own judgment and consider your personal circumstances when following any advice or recommendations from our Site.

No Professional Advice: The content on Indie Intrepid is provided for general informational purposes and reflects personal experiences and opinions. We are not licensed professionals in law, finance, medicine, travel consulting, or other regulated industries. Nothing on this site should be taken as professional advice. For instance, if we discuss budgeting for travel, it’s not financial advice tailored to you; if we talk about staying healthy abroad, it’s not medical advice. Always seek the advice of a qualified professional for any important decisions or specific questions you may have.

Provided “As Is”: The Site (including all content, functions, and services provided on the Site) is provided “as is” and “as available” , without warranty of any kind. To the fullest extent permitted by law, Indie Intrepid disclaims all warranties, express or implied, regarding the Site and its content. This includes, but is not limited to:

Direct Damages Cap: In jurisdictions that do not allow the exclusion of liability for certain damages, our liability is limited to the maximum extent allowed by law . If, notwithstanding the above, we are found liable to you for any damage or loss arising out of or connected to your use of the Site or these Terms, our total liability shall not exceed the amount (if any) that you paid to us to use the Site or $50 USD, whichever is greater. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at our own expense), and you agree to cooperate as fully as reasonably required with our defense of any such claim. You shall not settle any matter subject to indemnification without the prior written consent of Indie Intrepid.

This indemnification obligation will survive any termination of your use of the Site or these Terms.

10. Termination

These Terms are effective from the date you first access the Site and will remain in effect until terminated by either you or us.

By You: If you are dissatisfied with our Site, its content, or these Terms, you may discontinue use of the Site at any time. You may also request that we delete your personal information or remove content you’ve posted (as described in our Privacy Policy), and we will process such requests in accordance with our policies and applicable law.
By Us: We may terminate or suspend your access to the Site (or certain features of the Site) at any time, with or without notice, and for any reason, including if we believe you have violated these Terms or acted in a manner that could cause legal liability or harm to others. We also reserve the right to discontinue the Site or any portion of it at any time (for example, we could decide to shut down the blog or archive content).

11. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to these Terms or your use of the Site will be governed by and construed in accordance with the laws of the State of Texas, USA , without giving effect to any conflict of law principles that would cause the laws of a different jurisdiction to apply.

If you are a consumer residing in a jurisdiction with laws that give you the right to have disputes governed by local law or resolved in local courts (eg, EU consumers), those rights may supersede the above to the extent required by law.

Jurisdiction and Venue: You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the federal or state courts located in the State of Texas. You consent to the personal jurisdiction of such courts and waive any objections (such as inconvenience of forum) to the exercise of jurisdiction by those courts.

Please note that the Site is operated from the United States. If you access the Site from outside the US, you do so on your own initiative and are responsible for compliance with any local laws.

We may modify or update these Terms from time to time at our discretion. When we do, we will update the “Last Updated” date at the top of this document. All changes are effective immediately when we post them.
